Status Report: Nullifying the National Surveillance State

In 2014, the Tenth Amendment Center dove headfirst in the fight against unconstitutional federal surveillance when it spearheaded efforts to turn off the water at the NSA facility in Bluffdale, Utah, and cut off other critical state and local services to other NSA facilities.

We haven’t turned off the water in Utah — yet. But we did win some victories. In 2014, California Gov. Jerry Brown signed SB828 into law, laying the foundation for the state to turn off water, electricity and other resources to any federal agency engaged in mass warrantless surveillance. In 2018, Michigan built on this foundation with the passage of HB4430. The new law prohibits the state and its political subdivisions from assisting, participating with, or providing “material support or resources, to a federal agency to enable it to collect, or to facilitate in the collection or use of a person’s electronic data,” without a warrant or under a few other carefully defined exceptions. 

Although NSA spying remains the most high-profile warrantless surveillance program, the federal government has created a national surveillance network that extends well beyond the operation of this single agency. In fact, state and local law enforcement have become vital cogs in the national surveillance state. …

Teachers call Child Services when kids miss online class

Teachers are serving as the state’s newest surveillance into your home. The Massachusetts Department of Children and Families issued a fact sheet for teachers outlining when they should call DCF– the agency which can take your children and put them in foster care. Did a kid miss an online class? Call in child services, because that could be evidence of neglect. Teachers are also encouraged to pry into the home life of students on camera. “Who is home today to help you with learning?” “I’m having a hard time hearing you due to background noise/I’m hearing some other noises in the background, what else is happening at your house today?” “I saw a person walk by your screen, who is home with you today?” One mother has already had a DCF visit for leaving her 7-year-old boy with his teenage brother while she worked. They used to call that babysitting. Now, apparently, it’s neglect.…

Meet the Israeli Intelligence-Linked Firm Using AI to Profile Americans and Guide US Lockdown Policy

An Israeli government contractor founded by a former Israeli spy has partnered with one U.S. state and is set to announce a series of new partnerships with other states and U.S. healthcare providers to monitor civilian health and use an IDF-designed AI system to profile Americans likely to contract coronavirus and to inform U.S. government lockdown policy.

A company tied to Israel’s military signal intelligence unit, Unit 8200, has recently partnered with the state of Rhode Island to use an artificial intelligence-based system developed in tandem with the Israel Defense Forces (IDF) to profile Americans potentially infected and/or “at risk” of being infected with coronavirus, then informing government authorities of their “risk profile.” Once flagged, state health officials can target those individuals as well as their communities for mandatory testing, treatment and/or more restrictive lockdown measures.

The firm, Israel-based Diagnostic Robotics, is poised to announce a series of new such partnerships with several other U.S. states as well as major U.S. hospital systems and healthcare providers in the coming weeks, according to a company spokesperson. The first of these announcements came on June 30 regarding the firm’s new partnership with Mayo Clinic, which will soon implement the Diagnostic Robotics’ “artificial intelligence platform that predicts patients’ hospitalization risk.”…

It doesn’t require too dark an imagination to realize the gravity of the concerns over the digital yuan. China is a true pioneer when it comes surveillance, censorship and political oppression and the digital age has given an incredibly efficient and effective arsenal to the state. Adding money to that toolkit was a move that was planned for many years and it is abundantly clear how useful a tool it can be for any totalitarian regime. The ability to track citizens’ transactions, access their financial data, control and freeze the account of anyone that presents a potential threat, it all opens the door to the ultimate oppression: total control over private resources, over people’s livelihoods and their capacity to cover their basic needs. If we accept that digital currencies are inevitable and arguably their emergence has been accelerated by the corona crisis, the real question is who controls them, who issues and distributes them, and who determines their value. We stand at a historic crossroads and the answer to these questions can determine the kind of future we’ll wake up to. It can be a very bleak one, if the power remains with governments and centralized institutions. In this scenario, money will retain all the flaws and vulnerabilities of today’s fiat currencies, only its digital nature will amplify them to an unimaginable extent.…
